Section 1: Acceptance of Terms

1.  Acceptance Of These Terms Of Use

Your use of the H website www.hfurniture.co and /or any other information exchange media, made available by H Furniture Limited (“H”, “we“, “us“)  and purchase of furniture, accessories and other related products (the “Products”) via our Sales team is governed by these terms of use (“Terms of Use”).

By accessing our website and/or using it you accept and undertake to be bound by these terms of use. If you do not accept these terms of use, do not access and/ or use the website.

Subject to your acceptance of and compliance with these Terms of Use, H grants you a personal, limited, non-exclusive, revocable and non-transferable license to use our website solely for personal and non-commercial purposes as set forth in the Terms of Use.

Please note that the terms and conditions relating to privacy and protection of your personal information are governed by the privacy policy (“Privacy Policy”). You hereby confirm that you have read and accept the Privacy Policy [please insert link to Policy].

3. Interruption Of H Website

H shall use its reasonable endeavours to make the website accessible and functional for customer 24 hours a day.  H shall accept no liability for any lack of availability or applicability of the website caused by technical problems at the sub-suppliers of the internet homepage design, technology and hosting, and electronic payment gateway services.

H may (at its absolute discretion) interrupt the access to the website and system at any time and without notice in order to maintain and update such. H shall use its reasonable endeavours to ensure that such interruption is as brief as possible and if possible takes place at a time when likely to cause minimum customer disruption.

Section 2: Terms And Conditions

1. Payment

Price in GBP (Pound Sterling) includes packaging, UK VAT, excludes import/export duties and taxes.
A minimum deposit of 50% is required at the time of order. Full payment must be paid prior to delivery.
H Furniture remains the owner of the goods until full payment and any interest due are received.
When full or partial payment is not made on due date, H Furniture can, by registered letter, request return of goods without losing any rights of suit. Further, H Furniture has the right to cancel orders by written notification.

2. Lead Time

8 to 10 weeks from the time when order is placed.

3. Order Confirmation

No order will be entered into production until all the information from the buyer is received in writing by H Furniture. Goods will be supplied as per the order confirmation. If you are in disagreement with the confirmation you must advise us within seven days of the date thereof. H Furniture is not required to accept changes of order after the order confirmation is accepted and order placed.

4. Our Guarantee

Two year warranty. Guarantee on Made To Order products with bespoke fabrics are dependent on warranty provided by fabric supplier.

5. Right of Property

H Furniture Ltd retails all rights to the products until the relevant invoice has been settled in full.

6. Returns

Order amendments may be made only if feasible and are at our discretion.
Made To Order products (i.e. non stock goods, bespoke finishes) are non returnable or exchangeable unless genuinely faulty. After a confirmation is issued, the customer cannot cancel an order without the written consent from H Furniture.

A cancellation and/or restocking charge of up to the total amount of order may be applicable on orders canceled.

When purchase an item that is in stock (i.e. not made to order) the customer has the right to cancel the contract and return items to H Furniture up to 14 days after delivery subject to the conditions below.

Any products that are returned should be unused and in their original packaging. Therefore, the customer need to check goods thoroughly to ensure they are satisfied before disposing of the packaging. If the customer request a refund, H Furniture will refund the amount paid for the goods excluding the original delivery and the charge for returning the goods (unless they are faulty or damaged).

The delivery charge is non-refundable.

If the customer fail to take reasonable care of the goods before they return to H Furniture and this causes the damage or deterioration of the products, H Furniture will charge the customer for the reduction in value.

7. Delivery and Transport

Delivery dates acknowledged by H Furniture are non-binding estimates only, based upon the best available information concerning manufacturers lead times and transportation schedules. Therefore, orders may be shipped on, prior to (with the buyers’ approval) or after the estimated date (after notification to the buyer).

Delivery terms will be considered as accepted by the buyer unless disagreement is notified to H Furniture in writing within seven days of order placement.

Special delivery conditions requested by the buyer should be given in writing at the time of order placement and if necessary charges may change accordingly. From delivery or placement into storage all risks for the goods pass to the buyer. Nationwide UK or overseas shipping charges, are calculated from London by our delivery partner.

Countries outside the UK may incur customs duty on delivery, please inquire locally for further information.

Orders are delivered in London by single drivers to the ground floor or your property only. Should you require a different level of service please notify [email protected] be advised that the level, type and cost for delivery will vary according to the country of destination.

8. Damages

Our products are quality checked before leaving the factory in perfect condition. The buyer should also inspect carefully all items at time of receiving the goods.

Claims for damage and shortages must be notified to H Furniture within two days and written notification received within seven days. We cannot accept responsibility for the non-arrival of notification within the specified time. Failure to make such claims within the specified time constitutes acceptance of the merchandise and quality thereof.

H Furniture may not accept claims for damage resulting from storage by the buyer or storage by H Furniture on behalf of the customer and for damage resulting from accident, alteration or misuse after delivery.

Wood appearance: we supply high quality furniture grade wood. This may vary for grain, color, knots and other markings. We do our best to select and match as appropriate but we cannot accept returns on the basis of natural variations. Any special requirements for color, matching, etc. must be provided in writing. Wood warpage, shrinkage, and dimensional changes: wood is an active material, in that it is known to have dimensional changes depending upon moisture, temperature, humidity etc.

9. Disputes

Any disputes will be settled under English law in the courts of London who are deemed solely competent to settle any dispute concerning the sale.
